“Whoever unlawfully produces, processes, imports, exports, transports, dispatches, purchases, sells, stores, or possesses narcotic drugs or psychotropic substances for the purpose of distribution shall be subject to imprisonment for a term of not less than 3 years.”This provision criminalizes any act related to the handling of controlled substances when intended for distribution—not merely personal use. The threshold of “not less than 3 years” reflects the seriousness with which Polish law treats drug trafficking.
Article 165 §2
The penalty is significantly aggravated—imprisonment for not less than 5 years, up to life imprisonment—if the offense involves any of the following circumstances:
- The act concerns a significant quantity of drugs;
- It is committed as part of an organized criminal group or criminal association;
- It involves minors (e.g., selling to persons under 18, using them in trafficking, or committing the offense in their presence);
- The offense is committed near schools, educational facilities, or places intended for minors;
- Violence, threats, or abuse of a position of authority is used.
Article 165 §3
